These Terms of Service ("Terms") govern your access to and use of the PastullioBot website, application, and services (collectively, the "Service"). The Service is operated by Christopher Maffeo, doing business as PastullioBot ("PastullioBot," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
PastullioBot is an AI-powered analysis tool for prediction markets hosted on Kalshi. The Service scans publicly available Kalshi market data and applies AI-generated analysis to identify potential mispricings, presented as "edges" with confidence scores and expected value estimates.
The Service does not place trades on your behalf. It does not connect to your Kalshi account. It does not have access to your funds. PastullioBot is an information and analysis tool only. You are solely responsible for any decisions you make based on information provided by the Service.
You must be at least 18 years old and legally able to enter into a binding contract to use the Service. Prediction markets like Kalshi have additional age and jurisdictional requirements that are independent of these Terms — you are responsible for ensuring you comply with all laws and Kalshi's own terms in your jurisdiction. PastullioBot does not verify your eligibility to trade on Kalshi.
To use the Service, you must create an account by providing a valid email address and either using a magic-link authentication or setting a password. You agree to:

PastullioBot is not a registered investment advisor, broker-dealer, financial planner, or financial professional of any kind. The Service does not provide investment advice, financial advice, trading advice, or any kind of professional advice.
The analysis, signals, edge scores, expected value estimates, confidence percentages, and any other output produced by the Service are generated by artificial intelligence systems that:
Prediction market trading involves substantial risk of loss. You can lose all of the money you risk on Kalshi or any other prediction market. Past performance of any signal, edge, or analysis approach does not predict future results. Even high-confidence signals fail. Even mathematically positive expected value bets lose, often.

The Service operates on a credit-based model with optional subscription tiers:
Credit Tiers (one-time purchases): - Starter: 25 credits for $20 - Power: 75 credits for $50 - Max: 200 credits for $99
Subscription Tier: - Signals: $49/month, includes 60 credits per billing period plus additional features
Each scan consumes one credit. Specific feature inclusions and credit allocations may change; current details are displayed on the pricing page at the time of purchase.
Credit Expiration: Credits expire 6 months from the date of purchase. Expired credits are not refundable and cannot be reinstated.
Subscription Renewal: Subscriptions renew automatically at the end of each billing period unless cancelled. You may cancel at any time from your account page; cancellation takes effect at the end of the current billing period.
We offer a 7-day refund window from the date of purchase, subject to the following conditions:
Credit Purchases: - Eligible for full refund if fewer than 5 credits have been used at time of refund request - After 5 or more credits used, no refund
Subscription: - Eligible for full refund if no scans have been run AND no alerts have been delivered within the current billing period - After any scan or alert, no refund for that period; cancellation prevents future renewals only
To request a refund, email hello@pastulliobot.com with your account email and order/session ID. Approved refunds are processed via Stripe and may take 5-10 business days to appear on your original payment method.
After 7 days, all sales are final.
We reserve the right to deny refund requests that appear fraudulent or abusive, including pattern abuse (e.g., repeated buy-refund cycles).

We may terminate or suspend your account immediately for violation of these terms, with or without notice.
All software, design, branding, content, and analysis output produced by the Service are owned by PastullioBot or its licensors. You receive a limited, non-exclusive, non-transferable license to access the Service for your personal use. You receive no other rights.
The PastullioBot name, logo, and brand identity are trademarks (registered or common-law) of Christopher Maffeo. You may not use them without express written permission.
Kalshi market data displayed by the Service is sourced from public Kalshi API endpoints. Kalshi is not affiliated with PastullioBot, does not endorse the Service, and bears no responsibility for our analysis.
The Service relies on third-party providers:
We are not responsible for outages, errors, or data handling practices of third-party providers, except as required by applicable law.
We provide the Service on an "as is" and "as available" basis. We do not guarantee:
We may modify, suspend, or discontinue all or part of the Service at any time. We will make reasonable efforts to notify users of significant changes via email or in-app notice.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE SPECIFICALLY DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO:
NO ADVICE OR INFORMATION OBTAINED FROM THE SERVICE CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL PASTULLIOBOT, ITS OWNER, AFFILIATES, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID PASTULLIOBOT IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if PastullioBot has been advised of the possibility of such damages.
Some jurisdictions do not allow limitation of liability for certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless PastullioBot, its owner, and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
You may stop using the Service at any time by deleting your account from the account page or by contacting hello@pastulliobot.com.
We may terminate or suspend your access immediately, without notice, for any reason including violation of these Terms. Upon termination:
These Terms are governed by the laws of the State of Louisiana, USA, without regard to conflict of laws principles.
Any dispute arising out of or related to these Terms or the Service must be resolved as follows:
Informal resolution first. Contact hello@pastulliobot.com to attempt good-faith resolution. Most disputes can be resolved this way.
Binding arbitration. If informal resolution fails within 30 days, disputes will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in Caddo Parish, Louisiana, or remotely at the arbitrator's discretion.
Class action waiver. You agree to bring any claim individually and not as part of a class action, collective action, or representative proceeding.
Small claims exception. Either party may bring an individual claim in small claims court if it qualifies.
If any part of this section is found unenforceable, the rest remains in effect, except that the class action waiver, if found unenforceable, makes this entire arbitration section void.
We may update these Terms periodically. The "Last Updated" date at the top reflects the most recent revision. Material changes will be communicated via email to your account address or via in-app notice at least 14 days before taking effect.
Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, stop using the Service and contact us for any applicable refund.
